These Text Messaging Terms explain how text messaging works with Growthlio OÜ ("Growthlio", "we", "us"), registered in Estonia under number 16945139, Vanemuise tn 46-8, Nõmme linnaosa, Tallinn, Harju maakond 10911, Estonia. They sit alongside our Privacy Policy and Website Terms.

Section 1Two kinds of text

There are two different kinds of text message connected with Growthlio. This page covers both so you know which one you are dealing with.

Growthlio's own texts. Texts that Growthlio sends from its own number to people who contacted Growthlio or asked to hear from us. Sections 2 to 9 describe this programme.

A business's texts to its own customers. Growthlio builds and runs follow-up software for home service businesses. When a business uses it, the business sends texts to its own past customers and people it has quoted, in the business's name, from a number registered to that business. Those are the business's messages, not Growthlio's. The business is the sender and holds your consent, and its own privacy notice applies. Section 8 explains what that means for you.

Section 2Growthlio's own text programme

Programme name: Growthlio.

Who sends: Growthlio OÜ.

What we send:

  • replies to an enquiry you made, such as answers to a question or a link you asked for;
  • messages about a call or appointment you booked with us, such as confirmations, reminders and changes; and
  • occasional marketing texts, only if you ticked the separate, optional box on a Growthlio form that agrees to receive them.

How you opt in. You opt in on a Growthlio form, by giving us your mobile number and, for marketing texts, ticking the separate unchecked box that agrees to receive marketing and informational texts from Growthlio, including messages sent using automated technology and artificial intelligence. Booking a call or downloading something does not sign you up for marketing texts. Only the separate box does that. Consent to receive marketing texts is never a condition of buying anything or of receiving anything from us. Where you give us your number by texting us first, we reply to that conversation only.

You must be at least 18 years old and the user of the mobile number you give us. Our texts go to US mobile numbers.

Section 3Message frequency, cost and eligibility

Message frequency varies. Messages in a conversation you started, or about a booking you made, come as the conversation or booking needs them. Marketing texts, if you opted in to them, are occasional offers and updates.

Message and data rates may apply. Your mobile carrier may charge you for messages you send and receive. Check your plan. We do not charge you for texts.

Quiet hours. We send marketing texts only between 8:00 am and 8:00 pm in your local time, worked out from the address or area on your record. If we do not know where you are, we do not send you a marketing text.

Section 4Automated assistants

Some of our messages are written or answered by an automated assistant that uses artificial intelligence. If you ask whether you are talking to a person, it tells you it is an automated assistant. A member of the Growthlio team reviews our messages. The assistant works within rules we set, and a person takes over when a question needs one.

Section 5States where we do not send marketing texts

We do not send marketing texts to numbers or addresses in Texas, Florida, Oklahoma, Washington or Maryland. People in those states can still receive texts about a call they booked with us, and replies to an enquiry they made, and can use email.

Section 6How to stop or get help

To stop: reply STOP to any text. You may also reply END, QUIT, CANCEL, UNSUBSCRIBE or STOPALL, or tell us in plain words, such as "please stop texting me". You can also email [email protected]. We stop marketing texts straight away, send you one short message confirming it, and send you nothing further. We act on every opt-out as soon as we can and always within ten (10) business days.

If you stop marketing texts, we may still text you about a call you already booked, until the call has happened, unless you tell us you want those to stop too.

For help: reply HELP to any text, or email [email protected]. Our reply to HELP says: "Growthlio: for help, email [email protected]. Reply STOP to opt out. Msg and data rates may apply."

If you stop texts and later want them again, you can agree again on one of our forms.

Section 7Your information

We use your mobile number and the content of our messages to run this programme, as our Privacy Policy explains. Mobile information and text messaging opt-in data and consent are not shared with third parties or affiliates for marketing or promotional purposes. We share information only with the service providers that carry our messages and help us run the programme, on our instructions, and where the law requires. The providers we use to deliver client services are listed at growthlio.com/sub-processors. We keep records of consent and opt-outs for five years, and keep opt-out records for as long as we need them to keep honouring the opt-out.

Section 8If a business texts you using Growthlio's software

If you got a text from a business that says it is automated, or that comes from a home service company you have dealt with, it may have been sent with software Growthlio runs for that business. In that case:

  • the business is the sender, and the text is the business's message, sent from a number registered in the business's name;
  • the business is responsible for holding your permission to text you, and for what its messages say;
  • the business's own privacy notice describes what it does with your information, and Growthlio handles that information only for the business, under its instructions;
  • replying STOP (or END, QUIT, CANCEL, UNSUBSCRIBE or a plain request to stop) stops that business's marketing texts, across all of its locations, and we apply it straight away; and
  • to ask a question, access or delete your information, or complain, contact the business first. If you cannot work out who the business is, email [email protected] and we will pass your message to the right one.

Section 9Carriers and availability

Carriers are not liable for delayed or undelivered messages. Delivery depends on your carrier and your phone and is not guaranteed. We may change, suspend or end any text programme at any time. Supported carriers may change.

Section 10Changes to these terms

We may update these terms. The "Last updated" date shows when. An update never creates or widens your consent to receive marketing texts. That consent comes only from what you agreed to when you gave it.
