Terms of Use

Section 1These Terms are not a services agreement

The Site is a marketing and information website. Nothing on it is an offer capable of acceptance, and using the Site does not create any client relationship.

Services are provided only under a separately signed Master Services Agreement and Statement of Work. If you are a client, that agreement governs the services and prevails over these Terms in respect of anything it covers.

Section 2Eligibility

You must be at least 18 years old and have authority to accept these Terms on behalf of yourself and any organisation you represent.

Section 3Permitted use

You may view, download and print Site content for your own internal, non-commercial evaluation.

You may not:

(a) copy, republish, redistribute, resell or commercially exploit any part of the Site;

(b) scrape, crawl, harvest or use any automated means to extract data from the Site, other than a search engine crawler obeying our robots directives;

(c) use the Site to develop, train or benchmark any competing product, or to train any machine learning model;

(d) reverse engineer, decompile or attempt to derive the source code of anything made available through the Site;

(e) interfere with the operation or security of the Site, or attempt unauthorised access to any system or account;

(f) submit false, misleading or third party information through any form on the Site;

(g) use the Site in breach of any applicable law, or in a way that infringes the rights of any person.

Section 4Intellectual property

All content on the Site, including text, graphics, logos, video, software, workflow designs, methodologies, frameworks, templates and their arrangement, is owned by or licensed to Growthlio and is protected by intellectual property laws.

"Growthlio" and the Growthlio logo are our trade marks. Nothing on the Site grants any licence to use them.

Case studies, frameworks and methodologies described on the Site are published for information. Describing a method does not licence you to use it, and does not transfer any right in the underlying implementation.

Section 5Content you submit

If you submit any content through the Site, including form submissions, enquiries, comments or files, you:

(a) grant us a non-exclusive, worldwide, royalty free licence to use it for the purpose of responding to you and operating the Site;

(b) confirm you have the right to submit it; and

(c) accept that we treat unsolicited ideas and suggestions as non-confidential and may use them without restriction or compensation.

Do not submit confidential information through the Site. Use a signed agreement for that.

Section 6Communications and consent

Where you provide your telephone number or email address through a form on the Site, you consent to be contacted as described in the consent text presented at that form and in our Privacy Policy.

You may withdraw consent at any time by replying STOP to any text message, using the unsubscribe link in any email, or emailing [email protected]. We will action withdrawal across all channels within ten (10) business days.

Section 7No professional advice

Site content is general information only. It is not legal, regulatory, compliance, tax, financial or professional advice, and must not be relied on as such.

In particular, any content on the Site describing communications law, marketing regulation, artificial intelligence disclosure requirements, consent standards or data protection obligations is general commentary, is not tailored to your circumstances, may be out of date, and is not a substitute for advice from a qualified lawyer in your jurisdiction. You are responsible for your own compliance.

Section 8No performance representations

Any result, figure, case study, testimonial or projection shown on the Site describes a specific past engagement and is not a representation, warranty or guarantee of the results you would achieve. Results depend on factors specific to your business, market, offer, data and execution. Many clients do not achieve the results shown.

Section 9Artificial intelligence

Parts of the Site and our services may use artificial intelligence to generate content and to conduct automated conversations. Where you interact with an automated agent on the Site or through a channel we operate, that agent may be an artificial intelligence system and will identify itself as such where required. AI generated output can be inaccurate. Verify anything you intend to rely on.

Section 10Third party links and platforms

The Site may link to third party websites and platforms. We do not control them, do not endorse them, and are not responsible for their content, practices or availability. Your use of them is governed by their own terms.

Section 11Availability

We provide the Site on an "as is" and "as available" basis. We do not warrant that it will be uninterrupted, timely, secure, error free, or that any content is accurate or complete. We may change, suspend or discontinue any part of the Site at any time without notice.

Section 12Disclaimer of warranties

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS, IMPLIED OR STATUTORY, INCLUDING ANY IMPLIED WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT AND ACCURACY, IN RESPECT OF THE SITE AND ITS CONTENT.

Section 13Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

(a) we are not liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for loss of profit, revenue, business, goodwill, data or anticipated savings, arising out of or relating to your use of the Site, under any theory of liability;

(b) our total aggregate liability arising out of or relating to the Site will not exceed one hundred United States Dollars (USD 100).

Nothing in these Terms excludes or limits liability for fraud, death or personal injury caused by negligence, or any other liability that cannot lawfully be excluded. Some jurisdictions do not allow certain exclusions, in which case the exclusions apply to the extent permitted.

This Section does not apply to services provided under a signed Master Services Agreement, which contains its own liability provisions.

Section 14Indemnity

You will indemnify and hold us harmless from any claim, loss, liability, cost or expense (including reasonable legal fees) arising from your use of the Site in breach of these Terms or of any applicable law.

Section 15Privacy

Our handling of personal data is described in our Privacy Policy, which forms part of these Terms.

Section 16Changes to these Terms

We may update these Terms at any time by posting a revised version with a new "Last updated" date. Continued use of the Site after that date constitutes acceptance. Check this page periodically.

Section 17Governing law and jurisdiction

These Terms and any dispute arising out of or in connection with them, including non-contractual disputes, are governed by the laws of Estonia. The courts of Estonia have exclusive jurisdiction, save that we may bring proceedings to protect our intellectual property in any competent court.

To the maximum extent permitted by law, you waive any right to a trial by jury and any right to bring or participate in a class, collective or representative action in connection with the Site.

Section 18General

18.1 If any provision is held invalid or unenforceable, it will be modified to the minimum extent necessary or severed, and the remainder continues in force.

18.2 Our failure to enforce a right is not a waiver of it.

18.3 These Terms, together with the Privacy Policy, are the entire agreement between you and us in respect of the Site.

18.4 You may not assign these Terms. We may assign them in connection with a merger, acquisition or sale of assets.
